These terms and conditions apply to the Caterit website and all its applications on devices such as iPhones, iPads, Android, and others. Please read these terms and conditions carefully before placing any orders through our applications.
Your agreement to comply with the terms and conditions below is considered upon visiting our website or any of its applications on smart devices or when purchasing any goods or services using our website or any of its applications on smart devices. Please note that you will not be able to request any service through our website if you reject these terms and conditions. If you do not agree with the specified terms of use, you should refrain from any future use of the Caterit website.
- 1.0 Information about Caterit:
- 1.1 We (referred to later as "we," "the seller") operate this website and all its applications on all platforms (referred to later as "the website" or "the application") Caterit. It is a means of arranging events, including catering and banquet orders, and is owned by Gazarah Company based in Riyadh.
- 2.0 Terms and Contracts:
- 2.1 These terms and conditions are only considered as a notice for any sales offer and any subsequent contract.
- 3.0 Service Applicant Status: When requesting any goods or services through our application, you ensure the following:
- 3.1 Legally entering into binding contracts;
- 3.2 You are at least 18 years old, and all users considered minors (under 18 years old in general) in the legal jurisdiction in which they reside must obtain permission and be under direct supervision of a parent, guardian, or legal custodian when using this website. If you are a minor, your parent, guardian, or legal custodian must read and agree to this agreement before using the website.
- 3.3 You are a resident in one of the countries where we offer our services.
- 4.0 Contracting:
- 4.1 Caterit:
- Caterit is a platform that allows our customers or members to order food and services from restaurants and businesses that collaborate with us. Our applications and website are merely a means to choose from the restaurants listed on our platform and record your orders. We do not own these restaurants and businesses, and we have no ability to influence them. We act solely as intermediaries.
- 4.2 Ordering Process:
- Interactive menus or services allow customers to prepare and record their orders with a single button press. After registering your order, please note that this does not automatically mean your order has been accepted. Your order only constitutes an offer to purchase food or services from the restaurants or businesses collaborating with us. All orders require approval from the respective restaurant or company, and we confirm this approval through an in-app notification acknowledging their acceptance of your order. The contract between us only becomes effective after sending this confirmation message, and payment is made through the available methods on the application.
- 4.2.1 Contract Scope:
- The contract only includes the goods or services that have been ordered and confirmed. We are not obligated, under the contract, to provide assistance in obtaining any service or other goods, whether expected or not.
- 4.3 Applicability of Terms and Conditions:
- These terms and conditions apply to all orders across all Caterit platforms, whether the website or our applications on all platforms, canceling any other terms. The confirmation of the order from you is considered an acceptance of these terms and an acknowledgment that they are the sole conditions applicable to the contract, with no other imagined terms being valid.
- 5.0 Payment Terms:
- 5.1 Full Payment:
- The full value of all orders placed through Caterit's website or any of our applications must be paid before the products or services are provided to you.
- 6.0 Delivery and Acceptance of Products:
- 6.1 Ownership:
- After payment, the products become your property.
- 6.2 Verification of Information:
- You must check and correct any entered information before clicking the "Checkout" button, as errors cannot be corrected afterward. We begin processing your order upon receipt and send an in-app message confirming the successful notification of your order to the restaurant. If any payment transaction is rejected or not processed, we are not obligated to provide services to you.
- 6.3 Customer Unavailability:
- If the customer is not available at the specified address during the restaurant's delivery operations, orders will not be delivered to any other address. You are responsible for all legal obligations arising from ordering any meals to an address proven to be incorrect. In such cases, the money paid will not be refunded.
- 6.4 Authorized Recipient:
- There must be an authorized person to receive the order at the specified delivery location.
- 7.0 Discounts and Offers:
- 7.1 Restaurant Responsibility:
- Restaurants collaborating with us are solely responsible for menu prices, images, discount vouchers, and offers specific to the restaurant or company, as well as the minimum order value and any delivery fees stated on our application. Caterit is not responsible for any differences between the price list displayed on Caterit and the delivery list of the restaurant or service provider.
- 8.0 Gratuity and Delivery Fees:
- Some products and services in our application may be subject to additional financial fees depending on the category or service. When ordering anything subject to such conditions, additional fees will be added to your order. The ordering party is entirely responsible for paying any delivery fees along with the basic order.
- 9.0 Payment Settlement:
- 9.1 Payment for Orders:
- The value of orders placed through our application must be paid after specifying the services. No order will be processed until the fees are paid, and this is available only after the service provider approves the order.
- 9.2 Legal Pursuit:
- We reserve the right to pursue you legally to collect any outstanding amounts through a third party or through court proceedings.
- 10.0 Ownership:
- 10.1 Product Ownership:
- Product ownership and labels remain the property of the company or restaurant providing the products. Products are provided to you only after the full financial amount is paid.
- 10.2 Reservation of Rights:
- We reserve the right at all times to retain, block, or cancel any service, pending the full payment of the amount due.
- 11.0 Delivery:
- 11.1 Paid Delivery:
- The delivery process is a paid process included within the main order, where the service provider or restaurant is responsible for the delivery process.
- 11.2 Efforts for Timely Delivery:
- Every possible effort and care are taken to deliver the order on time, but it should be noted that any delivery time is an estimate, and we assume no responsibility for any losses resulting from delays or errors in order delivery. Under no circumstances do we take responsibility for the loss or damage of goods during the transportation process. In such cases, you should claim damages from the relevant restaurant according to its policies.
- 11.3 Responsibility for Delivery Errors:
- We are not responsible for the loss or damage of goods in case of any delivery error. You should provide clear instructions to the relevant restaurant for delivering orders to the desired location and deliver them to an authorized person to receive your order. In case of any delivery error, the responsibility for rearranging the delivery process lies with you and the restaurant according to its transport conditions.
- 11.4 Acceptance of Delivered Order:
- Accepting the delivered order constitutes acceptance of the products and, consequently, acknowledgment of compliance with the commitments in the contract. You should check the delivered products to ensure their accuracy and inform the delivery driver of any deficiencies or errors in the order. If you fail to do so, no complaint can be made regarding the delivery of a wrong order or any shortage in the delivered products or for any other reason.
- 12.0 Products:
- 12.1 We reserve the right to modify any details regarding the products or services advertised without prior notice. While we make every effort to accurately describe items on the application, we provide no guarantee of complete accuracy and assume no responsibility for any errors in the description or any resulting loss.
- 12.2 We neither sell nor manufacture the products nor do we interfere in any way with the production of any type of food in restaurants or services in companies. We only act as an intermediary between the customer and the service provider. The restaurants listed on our website and the service-providing companies commit to the laws, regulations, and local systems of any country they operate in, as well as the hygiene standards applicable to food preparation and the safety requirements related to sales, marketing, and services. Caterit assumes no responsibility for any restaurant or company failing to adhere to the acceptable and sufficient standards.
- 12.3 Caterit does not guarantee in any way the quality of any delivered products or the compliance of any delivered product with any applicable laws. Despite our efforts to provide accuracy in product descriptions, we cannot guarantee that the menu or services offered on the application perfectly match what is presented to users.
- 12.4 Any restaurant may declare the compatibility of its food with certain specific standards, such as "organic" food, "macrobiotic" food, or standards that consider certain allergies, such as "nut-free," "gluten-free," or "lactose-free." However, Caterit does not independently verify this and does not confirm the adherence of the food to these standards. Therefore, Caterit is not responsible if any of these foods are prepared differently or in an environment contrary to what is declared.
- 13.0 Price Quotations and Contracts:
- 13.1 Approved orders are subject to our right to adjust the prices listed in our application to consider any changes in prices or the terms of laws or regulations requiring us to raise prices directly or otherwise. Prices are based on current costs. In the event of any increase after confirming the approval of your order, we have the right to inform you and apply any increase to you.
- 14.0 Right to Cancel, Change Orders, and Refund Paid Amounts:
- 14.1 In case of an error in the order or a need to modify your order, you can cancel the order up to 14 days before the previously set delivery date and time within business hours. Any cancellation fees or modifications within 14 days of the specified delivery date and time are subject to the policy of each restaurant or company.
- 14.2 For orders placed on National Day, Independence Day, and holidays, you can cancel your order within 21 days of the previously set delivery date and time within business hours.
- 14.3 You must notify us of your decision to cancel the order. You can submit your request according to the instructions you receive. Orders that include any products prepared or designed specifically for you, such as celebration cakes, or any products specifically prepared according to specific dietary needs or flavors you personally choose, cannot be canceled, and the money will not be refunded. Any cancellation notice should be sent to the following email: support@caterit.app.
- 14.4 You cannot cancel your order in any case if the process of producing or delivering the food has already begun.
- 15.0 Consequences of Cancellation:
- 15.1 In the event of any permissible cancellation of the order, we work to refund all amounts paid for the purchased products or services. The refund is made to the customer's wallet in the application unless we explicitly agree otherwise. We reserve the right not to refund the money according to our absolute discretion.
- 15.2 Our contract with you is canceled, and you cannot claim any compensation for any damages, losses, or inconvenience.
- 16.0 Exceptions Regarding the Right to Cancel:
- 16.1 The right to cancel does not apply to: - Meals or products prepared or designed specifically for you. - Any products mentioned in paragraphs 14.3 and 14.4 above.
- 17.0 Pricing and Available Products:
- 17.1 All prices and price quotations listed on our application are offered based on availability only. We reserve the right to change prices at any time.
- 18.0 Defective Goods, Complaints, and Correspondence:
- 18.1 All complaints related to the quality of the ordered product must be sent directly to the relevant restaurant. We care about our customers' comfort, so you can contact us at support@caterit.app if you are unable to resolve your problem, and we will try to settle the complaint with the service provider. In such cases, our decision is considered final according to our absolute discretion.
- 18.2 Any complaint regarding any of the restaurants participating on our website should be filed within 7 days.
- 19.0 Liability and Compensation:
- 19.1 Any defects in goods that cause death, harm to health, or personal property damage are the responsibility of the service provider offering the services. Caterit does not assume responsibility for any event or incident resulting from defects in goods or products unless it is due to negligence on our part. Our responsibility for any loss or damage suffered as a result of any negligence on our part is limited to the value of the contracted goods.
- 19.2 We do not assume responsibility for any losses or damages arising from the provision of products under these terms and conditions. We are not responsible for:
- - Any delays in delivery that should be carried out by the restaurant.
- - Any delivery failure or non-delivery at all.
- - Any incorrect or inappropriate orders.
- 20.0 Change of Terms:
- 20.1 We reserve the right to change any of the terms and conditions stated here at any time without prior notice by updating the terms and conditions data on our application.
- 21.0 Intellectual Property Rights for Images, Content, and Graphics:
- 21.1 Caterit respects the intellectual property of others, and we request the same from our customers. Recognized intellectual property rights worldwide, including those related to graphics, designs, digital images, pictures, videos, films, audio, animations, and any other artwork appearing on our website or smart device applications, always remain ours. Additionally, all content on Caterit, including restaurant descriptions and menus, remains our property. We assert our intellectual property rights under copyright, design, and patent laws and will always seek to prevent any unauthorized use, quoting, production, copying, or imitation of the contents of our site or the designs and/or artworks included in it. This includes our right to file any legal claims. Trademarks and copyrights for any mentioned third party on our website or smart device applications remain the property of their respective owners.
- 22.0 Force Majeure:
- 22.1 We do not take responsibility for any failure or delay in fulfilling your service or the inability to serve you for any reason beyond our reasonable control. In such circumstances, we have the right to notify you of terminating the contract, whether wholly or partially, without assuming any liability of any kind towards you.
- 23.0 Miscellaneous:
- 23.1 We are not bound by customer order-specific terms and conditions. Our comprehensive terms and conditions are the only ones applied unless otherwise agreed upon in writing.
- 23.2 These terms and conditions may be modified from time to time. The latest version of these terms and conditions can be found on our applications or our official website or upon request.
- 24.0 Payment for Services:
- 24.1 When you order our products, you authorize us or our payment processing agent to collect your credit card purchase fees, delivery fees, any applicable taxes, and any other fees that may result from your use of our services. We ensure the confidentiality of financial details and will not disclose them to any third party as part of any payment process except the payment system provider.
- 24.2 You must keep passwords or login details needed to use our services secure and not disclose them to any unauthorized person. You are solely responsible for all orders placed using your account.
- 25.0 Applicable Law and Jurisdiction:
- These terms and conditions are interpreted in accordance with the laws of the Kingdom of Saudi Arabia and are subject to them. Saudi Arabian judiciary has exclusive jurisdiction over all disputes related to these terms or arising from them.
